INSTRUCTIONS FOR BAD CHECK COMPLAINTS
In order to qualify for the Restitution Program the check(s) must have been written/accepted in Jackson County, be written on a Closed Account, No Account or NSF $100.00 or more. Post dated and Stop Payment checks are civil not criminal and need to be pursued in Civil/Small Claims court. The phone number for Civil Claims is 517-788-4037. There are three forms used for the Restitution Program: The 5 Day Notice, Person who Accepted the Check and the Victim Information Sheet.
Below are the steps that should be followed to recover of your money:
1. Fill out the “5 Day Notice” to the bad check writer and send it certified mail, return receipt requested.
In the first box (important notice) write the check writers name and address.
In the box that describes the check, you may also add a $35.00 fee to cover your handling losses.
The bottom information is your contact information.
2. Have the person who actually accepted the check complete the “Person Who Accepted the Check” form to the best of their ability. Incomplete reports decrease the chance of collection/conviction.
3. Complete the “Victim Information” form, the victim is the person (or business) out the money.
The bottom section of the form is the person who will be responsible for answering questions regarding the complaint.
4. Once the postal carrier returns to you either the signed green certified mail receipt card or the entire envelope which was unclaimed you are ready to file your complaint with our office.
Send or bring the two forms, a copy of the 5 Day Notice, a copy of what the postal carrier returned to you and copies of the front and back of the check.
Keep copies for your records.
Once the complaint is filed with our office do not accept payment.

Landlord/Tenant Check Cases:
Cases which arise between parties because of a landlord/tenant relationship, require the party who received a Bad Check, to first:
A. File a civil law suit in Small Claims or District Court.
B. And receive a judgment from the court.
Copies of all the paperwork and the judgment must also be attached to your request for assistance to this office.
